General Terms and Conditions for Competitions and Prize Draws Organised by recalm GmbH

1. Scope

These general terms and conditions apply to competitions, prize draws and similar promotions (hereinafter collectively referred to as ‘promotions’), particularly online promotions, organised by recalm GmbH, Gasstr. 16, 22761 Hamburg (hereinafter referred to as ‘organiser’).

2. Reference to special conditions of participation

Each individual promotion has special conditions of participation, which can be found in the promotion text.
The special conditions of participation include, in particular, information about the procedure, participation deadlines, prizes and the modalities for determining the winners. In the event of discrepancies, the special conditions of participation take precedence over these general conditions of participation.

3. Participation/exclusion

  • Participation is free of charge and independent of the purchase of a product or service from the Organiser.
  • Persons excluded from participation are not entitled to any prizes, even in the event of a draw.

Minimum age

Participation is open to persons aged 18 and over. Minors require the express consent of a parent or guardian.

Territorial restriction

Only persons with permanent residence in Germany, Austria or Switzerland are eligible to participate, unless the special conditions of participation provide otherwise.

Employees and relatives

Employees of the organiser and their relatives are excluded from participation.

Misuse/manipulation

The organiser reserves the right to exclude participants in the event of multiple entries, mass submissions, manipulation or violations of the conditions of participation.

Participation in your own name

Participation is only possible in your own name. Prizes are non-transferable.

4. Types of prizes

The type of prize is specified in the special conditions of participation for the respective promotion.

  • Non-cash prizes are usually sent by post to the address provided by the winner.
  • Vouchers/digital prizes may be sent by email. Cash payments are excluded.

5. Data

Personal data (e.g. name, address, email address) is regularly required for the promotion to take place.
The participant is responsible for the accuracy of the information provided.

Data protection

The data will be processed exclusively for the purpose of conducting the promotion and will be deleted after its completion, unless there are legal obligations to retain it. Our privacy policy applies.

Revocation

Participants may revoke their consent at any time. This will also terminate their participation in the promotion.

6. Reservation of changes/cancellation

The organiser reserves the right to change, interrupt or terminate the promotion or the conditions of participation at any time without giving reasons, if this appears necessary.

7. Determination of winners

The winners will be determined by the organiser or an authorised third party after the participation deadline has expired. Details can be found in the special conditions of participation.

8. Notification/acceptance period

Depending on the respective platform or the specific conditions of participation for the promotion, winners will be notified either by direct message, email or another communication channel provided for in the promotion.
If a winner does not respond within 28 days, their claim will expire and a new winner will be determined.

9. Exclusions regarding the prize

  • Cash payment or transfer of the prize is excluded.
  • Any additional costs (e.g. travel, meals) that are not expressly mentioned as part of the prize shall be borne by the winner.
  • Legal recourse is excluded.

10. Collaborations

If the promotion is carried out in collaboration with partners, it may be necessary to pass on participant data to the respective partner for the purpose of processing the prize.

11. Conditions for social media competitions

Competitions carried out via social media platforms (e.g. Instagram, Facebook, Meta) are not connected to these providers and are neither sponsored, supported nor organised by them. The organiser, recalm GmbH, is the sole point of contact.

12. Liability

The organiser is not liable for technical faults that may occur during participation or the determination of winners, nor for damage resulting from the acceptance or use of the prize, unless this is due to intent or gross negligence on the part of the organiser.

13. Miscellaneous

The law of the Federal Republic of Germany applies. The place of jurisdiction is – to the extent permitted by law – the registered office of the organiser.
